Firearms and Goods Terms and Conditions.General Terms & Conditions All firearms on this website are only available for purchase within Australia. Under Australian Federal Legislation all firearms purchases within any state or territory of Australia must comply with the following conditions: Transactions for firearms or firearm parts are bound by the relevant state & commonwealth laws. Please note. Legislative requirements for advertising firearms or firearm parts require that the seller must provide shooters licence or permit number plus the serial number of the firearm or part. NSW further requires that advertisements display the name and address of the licensed firearm dealer through which the transfer will be made. Your advertisement shall not be accepted without this required information. Definitions “firearms.net.au” is the online portal of "The Kings Armoury”. Eligibility Our services are available only to, and may only be used by, persons who have a lawful firearms licence and can enter into legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to persons: (a) under 18 years of age; (b) who do not hold a lawful firearms licence; or (c) who are temporarily or indefinitely suspended The Kings Armoury - firearms.net.au account holders. Fees and Services When you list an item you have access to the fees that you will be charged for the use of our services and you will be legally bound to pay such fees or charges. We may change our Fees and Credits Policy and the fees for our services from time to time. Unless otherwise stated, all fees are quoted in Australian Dollars. You are responsible for paying all fees associated with using our service and our Site and all applicable taxes (including any goods and services). You must be legally able to sell and have the legal ownership of the item(s) you list for sale on our Site. You must provide the serial number of the firearm or gun you are selling. You must provide an accurate description of the item(s) you are selling on our Site. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item(s). Your Information Definition. "Your Information" means any information you provide to us. You are solely responsible for Your Information, and we act as a passive conduit for your online distribution and publication of Your Information. Liability Limit To the extent permitted by law, The Kings Armoury and related entities shall not be liable for lost profits or any special, incidental or consequential loss or damages arising out of or in connection with our site, our services or this Agreement (however arising, including negligence). You agree to accept sole responsibility for the legality of your actions under the laws which apply to you. You agree that The kings Armoury and related entities of The Kings Armoury have no responsibility for the legality of our account holders’ actions or User’s actions.To the extent permitted by law, the liability of The Kings Armoury and related entities, to you or any third parties in any circumstance whatsoever and howsoever arising is limited to the greater of: a. the amount of fees you pay to us in the 12 months prior to the action giving rise to liability; and b. AUD$100. Indemnity You agree to indemnify and hold The kings Armoury and related entities including but not limited to our subsidiaries, affiliates, officers, directors, agents, servants and employees, harmless from and against any claims, demands, proceedings, suit, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable solicitors' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. If you breach these terms and conditions then your account and subscription with The Kings Armoury will be suspended or cancelled. Jurisdiction The Kings Armoury - firearms.net.au is based in the State of Perth, Australia and you acknowledge that any advertisements placed by You through The Kings Armoury will be published in that State but will be available to be read by persons throughout the world. Legal Compliance You must comply with all applicable State, Territory and Commonwealth laws (including common law) and international laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase, offers to purchase or sell, and sale of items, as they apply in any place concerning your listing and sale, including Victoria (where the advertisement is published), the place from where you are offering your items for sale and the place to which your items may be sold. Specifically, you must ensure that your activities, the items you list, and Your Information do not violate, infringe or cause you to commit an offence or crime against the any and all Australian State Firearms Acts, Broadcasting Services Act 1992 (Cth), the Trade Practices Act 1974 (Cth) and corresponding Statutes, Legislation and Acts of the States, Territories and Commonwealth of Australia. Notwithstanding the successful conclusion of a transaction, you must ensure strict compliance with any particular formalities which, if not complied with, will either render a transaction void, voidable, unlawful or illegal. The Kings Armoury is not responsible for confirming that your activities are lawful. You must ensure that you comply with all applicable laws. You must also ensure that you comply with all clauses of this User Agreement. Please note: As of 2007 to our knowledge the Online sale of firearms is permitted in all states for private licensed individuals excepting for the state of Victoria. Persuant to section 101 of the firearms Act 1996 Firearms must not be advertised for sale on a website from the State of Victoria unless the seller is a licensed firearms dealer. No Agency You and The Kings Armoury are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement. Miscellaneous This Agreement shall be governed in all respects by the laws of Western Australia, Australia. All users of this Site irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia, Australia. The provisions of this agreement shall as far as possible be construed as severable provisions to the extent that where any such provision would be invalid or unenforceable, then the remaining provisions of this Agreement shall nevertheless be valid and enforceable. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
