General Terms & Conditions

By using this site you agree to be fully bound by the terms following. Customers please read carefully. Your usage of this site indicates your acceptance of these terms & conditions. By advertising on this site or ordering any product you also indicate your acceptance of these terms and condition.

All firearms on this website are only available for purchase within Australia. Under Australian Federal Legislation all firearms purchases within any state or territory of Australia must comply with the following conditions:

   1. The purchaser must be a current citizen or permanent resident of Australia.
   2. The purchaser must be a holder of a current firearms license within their state or territory of residence.
   3. The purchaser's current individual license category must meet the requirements of the firearm(s) being purchased.

Transactions for firearms or firearm parts are bound by the relevant state & commonwealth laws.

Please note. Legislative requirements for advertising firearms or firearm parts require that the seller must provide shooters licence or permit number plus the serial number of the firearm or part. NSW further requires that advertisements display the name and address of the licensed firearm dealer through which the transfer will be made. Your advertisement shall not be accepted without this required information.

 Definitions

“firearms.net.au” is the online portal of "The Kings Armoury”.

Eligibility

Our services are available only to, and may only be used by, persons who have a lawful firearms licence and can enter into legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to persons:

(a) under 18 years of age;

(b) who do not hold a lawful firearms licence; or

(c) who are temporarily or indefinitely suspended The Kings Armoury - firearms.net.au account holders.

 Fees and Services

When you list an item you have access to the fees that you will be charged for the use of our services and you will be legally bound to pay such fees or charges. We may change our Fees and Credits Policy and the fees for our services from time to time. Unless otherwise stated, all fees are quoted in Australian Dollars. You are responsible for paying all fees associated with using our service and our Site and all applicable taxes (including any goods and services).

 
Purchases through The Kings Armoury Website must also satisfy the following conditions:

Firearms will only be delivered directly to a nominated licensed firearms dealer for purchasers within Australia.
          * It is the responsibility of the purchaser to nominate their firearms dealer.
          * The firearm will be shipped directly to the nominated licensed firearms dealer after approval of the purchase and payment for the firearm.

All orders must be accompanied by the relevant documentation (current firearms license) as specified above before any sale will take place.

You must be legally able to sell and have the legal ownership of the item(s) you list for sale on our Site. You must provide the serial number of the firearm or gun you are selling. You must provide an accurate description of the item(s) you are selling on our Site. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item(s).

Making a Purchase online

It i the customers responsibility to please ensure that all contact details, delivery address etc are correct.We accept no responsibility for delivery problems caused by you providing incorrect shipping details. All items are shipped by registered mail. If there is a non-delivery issue because of our mistake will be replaced at no charge to you. We will send you correspondence and notices in respect to your transactions and your account. Our correspondence and notices do not represent any endorsement, guarantee, warranty, or legitimisation of your transactions. You are responsible for the completion of all your transactions (including but not limited to monitoring the status and complying with all relevant legal obligations). We do not control, endorse, warrant, guarantee or approve the items, information or content provided by other users which is made available through our Site. Other User’s information may be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using our Site. Please note that there are risks of dealing with underage persons or people acting under false pretence.

Warranty

No warranty whatsoever is either given nor implied. The Kings Armoury acts as a venue to allow members to offer, sell, and buy items (including firearms). The Kings Armoury is not involved in the actual transaction between buyers and sellers except for Kings Armoury ads. As a result, The Kings Armoury has no control over the quality, safety or legality of the items or content posted by users on the Site, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. The Kings Armoury cannot ensure and does not guarantee that a buyer or seller will actually complete a transaction or act lawfully in using our Site. We provide our web site and services on an "as is" basis and without any warranty, guarantee, representation or condition, express or implied or by statute and to the extent permitted by law, we disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. Furthermore we do not guarantee continuous, uninterrupted or secure access to our Site. We advise that numerous factors outside our control may interfere with your access to our site.

Your Information

Definition. "Your Information" means any information you provide to us. You are solely responsible for Your Information, and we act as a passive conduit for your online distribution and publication of Your Information.

Liability Limit

To the extent permitted by law, The Kings Armoury and related entities shall not be liable for lost profits or any special, incidental or consequential loss or damages arising out of or in connection with our site, our services or this Agreement (however arising, including negligence). You agree to accept sole responsibility for the legality of your actions under the laws which apply to you. You agree that The kings Armoury and related entities of The Kings Armoury have no responsibility for the legality of our account holders’ actions or User’s actions.To the extent permitted by law, the liability of The Kings Armoury and related entities, to you or any third parties in any circumstance whatsoever and howsoever arising is limited to the greater of:

a. the amount of fees you pay to us in the 12 months prior to the action giving rise to liability; and

b. AUD$100.

 Indemnity

You agree to indemnify and hold The kings Armoury and related entities including but not limited to our subsidiaries, affiliates, officers, directors, agents, servants and employees, harmless from and against any claims, demands, proceedings, suit, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable solicitors' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. If you breach these terms and conditions then your account and subscription with The Kings Armoury will be suspended or cancelled.

Jurisdiction

The Kings Armoury - firearms.net.au is based in the State of Perth, Australia and you acknowledge that any advertisements placed by You through The Kings Armoury will be published in that State but will be available to be read by persons throughout the world.

 Legal Compliance

You must comply with all applicable State, Territory and Commonwealth laws (including common law) and international laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase, offers to purchase or sell, and sale of items, as they apply in any place concerning your listing and sale, including Victoria (where the advertisement is published), the place from where you are offering your items for sale and the place to which your items may be sold. Specifically, you must ensure that your activities, the items you list, and Your Information do not violate, infringe or cause you to commit an offence or crime against the any and all Australian State Firearms Acts, Broadcasting Services Act 1992 (Cth), the Trade Practices Act 1974 (Cth) and corresponding Statutes, Legislation and Acts of the States, Territories and Commonwealth of Australia. Notwithstanding the successful conclusion of a transaction, you must ensure strict compliance with any particular formalities which, if not complied with, will either render a transaction void, voidable, unlawful or illegal. The Kings Armoury is not responsible for confirming that your activities are lawful. You must ensure that you comply with all applicable laws. You must also ensure that you comply with all clauses of this User Agreement.

Please note: As of 2007 to our knowledge the Online sale of firearms is permitted in all states for private licensed individuals excepting for the state of Victoria. Persuant to section 101 of the firearms Act 1996 Firearms must not be advertised for sale on a website from the State of Victoria unless the seller is a licensed firearms dealer.

No Agency

You and The Kings Armoury are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

 Miscellaneous

This Agreement shall be governed in all respects by the laws of Western Australia, Australia. All users of this Site irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia, Australia.

The provisions of this agreement shall as far as possible be construed as severable provisions to the extent that where any such provision would be invalid or unenforceable, then the remaining provisions of this Agreement shall nevertheless be valid and enforceable.

Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

Shipping

Please allow 14 to 21 working days for delivery within Australia.

Delivery is within Australia only.

Shipping of firearms will be quoted by contacting you by either phone or email after an order is placed but before it is processed.

Refunds

Please choose carefully when purchasing. We andeavor to describe condition as honestly as possible. All sales are final. Orders received incorrectly through the fault of The Kings Armoury will be replaced or exchanged at no additional charge to the customer.


Changes to Orders

We cannot change orders once they have been placed, although if notified by the customer of an order error (by email) we will do our best to rectify/correct the error to that particular order prior to shipping.

Payment methods

The Kings Armoury accepts payment by credit card, Visa, Mastercard, bank deposit, Cheque and Money Order (Goods despatched only when funds are cleared). Advertisers have their own payment preferences and it is the responsibility of the purchaser to arrange payment method with the advertiser. The Kings Armoury shall have the full right to cancel or refuse any or all orders placed for products listed at an incorrect price. This will also be applicable to orders placed and paid for by credit card. If the payment has been made or your credit card charged the The Kings Armoury will within 7 days credit the amount of the incorrect price.

Disclaimer for Products Sold

As stated herein The Kings Armoury has or makes no representations, warranties either express or implied of any kind in or with respect to any or all of the products sold and purchased on this site. In no way or event shall The Kings Armoury or it’s proprietor, associates or representatives be liable for consequential, indirect or punitive damages related to any or all products sold on this site.

 Please note: All old guns are sold as collectibles only and are NOT warranted for shooting.

Many of the guns listed at this website will be fine to shoot with appropriate ammunition. However there may be hidden safety problems with old firearms.

We recommend that no one should shoot ANY old gun without first having it thoroughly checked out & okayed by a professional competent gunsmith. Older guns originally made for blackpowder cartridges should never be fired with modern smokeless powder cartridges. Damascus barreled shotguns may have hidden defects – we recommend they not be fired.

Opinions expressed in this catalog as to mechanical condition of a gun merely indicate whether the gun appears to function without live ammunition, and do NOT necessarily mean the gun would be safe to shoot.
